During
the 78th Legislative Session, lawmakers created the Texas
Residential Construction
Commission (the “Commission” or TRCC). The Commission
provides homeowners and builders an opportunity to resolve
differences through an administrative process prior to pursing
court action.
The Commission will specifically be responsible for registering
homes, homebuilders and remodelers, overseeing the state-sponsored
inspection and dispute resolution process, preparing and
adopting limited warranties, and building and performance
standards,
overseeing three task force groups, providing a voluntary
certification of arbitrators, and providing for the filing
of arbitration
awards.
Starting January 1, 2004, all home builders and remodelers in
the State of Texas were required to register new homes, material
improvements to existing homes, and certain interior renovations
exceeding $20,000 with TRCC, as well as remit a $30 fee for each
registration. For remodelers, the registration and fee must be
sent to TRCC within 15 days following the earlier date of when
the agreement (contract) is signed or the work commences.

of their certificate from TRCC.

including House Bill 705 and House Bill 730. HB 705 requires
background checks on anyone entering a private residence
to perform a service. HB 730 requires contractors and certain
professions to uphold a warranty period on their work in

goes above and beyond by maintaining a two year warranty
period on all work performed by the company and offers a
10 year structural warranty on all room additions.
